1. Who We Are and What This Policy Covers

“ChargingNear.me,” “we,” “us” and “our” mean Wins Parking, LLC, a Colorado limited liability company located at 56 Edwards Village Blvd, Unit 124, Edwards, CO 81632, which operates ChargingNear.me. We are the business responsible for (the “controller” of) the personal information described here.

This policy covers the ChargingNear.me website, maps, tools, trip planner, alerts, emails, push notifications, AI concierge, developer API, MCP server and embeddable widget (the “Services”), and our communications with you about them. It does not cover the charging networks, station operators, map providers or other websites we link to, which have their own policies. Our Terms of Service and Cookie Policy also apply.

2. Information We Collect

What we collect depends on how you use ChargingNear.me. Most of the Services work without an account, and we do not ask for your name to browse, search or plan a trip.

What we collect, by how you use ChargingNear.me
How you use ChargingNear.meWhat we collect

Payment information

Payments are processed by Stripe. You enter your card details directly into Stripe’s checkout. We never receive or store your full card number. Stripe gives us limited details, such as your name, email, billing country and postal code, card brand and last four digits, amounts, tax, dates and payment status.

Information from others

We receive station and business information, which can include business contact details, from public sources, charging networks, data providers and map services. We may receive information about you from Stripe, from email and push-notification providers (such as delivery and bounce notices), and from public records, such as property parcel data for an address you give us.

Sensitive information

We do not ask for sensitive information such as government ID numbers, health information, race, religion or sexual orientation. Please do not include it in reviews, messages or concierge chats. Precise location is handled as described in Section 3.

3. Location Information

We use your device’s location only if you allow it. Before your browser asks for permission, we explain why we are asking. If you allow it, your browser shares your location with the page so we can show nearby chargers and plan routes. You can say no and search by city, address or ZIP code instead, and you can turn location off at any time in your browser or device settings.

We do not keep the precise location your device shares. When a search is saved to our search-demand records, its coordinates are rounded to two decimal places (roughly 1 kilometer, or about two-thirds of a mile) before they are written. Search records made before October 19, 2026 may contain more precise coordinates; we are reducing them to the same precision. Trip stops you save are the places you choose, not your device’s location.

4. How We Use Information

We use personal information to:

  • Provide the Services: show stations, maps and routes, save your stations, vehicles and trips, send the alerts you set up, and run your account and plans
  • Sign you in by email and keep your account secure
  • Process payments, renewals, refunds, taxes and disputes, and send receipts and renewal reminders
  • Run the API, measure usage, enforce rate limits and bill overage
  • Publish community content and keep reviews honest, including moderation and fraud checks
  • Respond to inquiries, including property-owner and business inquiries, by email, phone and text
  • Run the AI concierge and review conversations to improve answers and catch misuse
  • Send service emails, and marketing emails where the law allows, each with a way to unsubscribe
  • Measure and improve the Services using our own first-party analytics
  • Create aggregated and de-identified information, such as charging-demand statistics by area, which we may publish or license and which we do not try to re-identify
  • Detect, prevent and investigate fraud, spam, abuse, security incidents and unlawful activity
  • Comply with law, enforce our Terms, and protect the rights, property and safety of Wins Parking, LLC, our users and others

We do not make decisions about you based on automated processing that produce legal or similarly significant effects. Ranking stations and scoring their reliability is about stations, not people.

5. AI Concierge

The concierge is an AI assistant. Its first message tells you so. When you chat, we send your messages, along with station data and conversation context, to the AI model providers that power it, which currently are OpenAI (through our hosting provider Replit) and, as a backup, OpenRouter and the model providers it routes to. They process the conversation to generate replies under their business terms. The concierge may use the AI provider’s web search tool to answer a question.

We store conversations so the chat continues across visits and so our team can review them, improve the Services and handle requests you make in the chat. To apply free-use limits we store a hashed code of your IP address; chats started before October 19, 2026 may hold the address until deleted. If you share an email address or phone number and ask us to follow up, we save it as an inquiry (Section 6). Conversations are deleted 12 months after their last message, or sooner if you delete your account or ask us to.

We do not use your data to train AI models. Prices are never personalized.

6. Emails, Texts and Calls

Emails

We send service emails you need, such as sign-in codes, receipts, renewal reminders, alerts you set up, and notices about your account, plan or listing. With your permission or where the law allows, we also send newsletters, digests, recaps and follow-ups. Every marketing email has an unsubscribe link and our postal address. Unsubscribing does not stop service emails about an active account or plan. We turn off open and click tracking in our emails.

Texts and calls

When you give us your phone number, whether through a form, the concierge, by calling us or by texting us, you agree that Wins Parking, LLC may call and text you at that number about your request, including with automated and AI-assisted calls and texts. If you separately agree to receive marketing texts, we may also send you offers and updates. You confirm that you are the subscriber or customary user of the number you give us and that you may consent for it.

Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out at any time; you may receive one final text confirming your opt-out. Reply HELP for help, or contact us at (970) 279-1744 or privacy@chargingnear.me. Reply START to opt back in. Carriers are not liable for delayed or undelivered messages.

Calls to and from us may be recorded and transcribed for quality, staff training, record keeping and to carry out your request, and may be answered or placed by an AI assistant. You can ask for a person at any time.

We never share your mobile number or texting consent

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. How We Share Information

Service providers may use the information only to provide services to us, except where they act under their own terms as noted above. We may also share information:

  • Publicly, when you choose to. See Section 8.
  • For legal reasons: to comply with law, subpoenas, court orders and lawful requests from authorities, and to protect the rights, property and safety of Wins Parking, LLC, our users and others.
  • In a business transfer: in connection with a merger, sale, financing, reorganization or transfer of all or part of our business or assets, including during negotiations. The recipient must honor this policy for the information transferred.
  • With your direction or consent.
  • As aggregated or de-identified information, which does not identify you and which we may publish, license or sell, including through our API and data products.

Demand Graph cells publish only from 3+ searches; no visitor ID, IP address or query text is in any product we sell.

8. Public Content and Our API

Content you post for others to see is public. Reviews, ratings, photos and tips appear on station pages with the display name you choose. If you turn on a public driver profile, anyone can see its name, contributions and points. Trip links you create can be opened by anyone who has the link.

Public content, with its display name, is part of the station data we provide through our website, API, MCP server and widget, including to paying API customers and AI services, and it may be copied by search engines and others. Information you make available to the general public this way is treated as publicly available information under state privacy laws. If you delete your account, your reviews, photos and tips remain on station pages without your name.

9. Cookies and Similar Technologies

We use a small number of first-party cookies and browser storage to keep you signed in, remember your choices and settings, keep the site secure, count visits and searches, and let saved trips work offline. We do not use advertising cookies, tracking pixels or third-party analytics. Our Cookie Policy lists each one and how long it lasts.

We honor Global Privacy Control (GPC). If your browser sends a GPC signal, we treat it as a request to opt out of the sale and sharing of your personal information and of targeted advertising for that browser, and our pages will not load any third-party analytics tools in it. When you are signed in, we also apply it to your account. There is no common standard for “Do Not Track,” so we respond to GPC instead.

10. Data Retention

We keep personal information only as long as needed for the purposes in this policy, and then delete or de-identify it:

Retention periods

11. Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information, including encryption in transit, access controls, hashed sign-in codes and API keys, private backup storage, and payment handling by a PCI-compliant processor. No system is perfectly secure, and we cannot guarantee the security of information you send us or that we or our providers store. If we learn of a security breach affecting your personal information, we will notify you as the law requires.

12. Children

The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. Accounts, purchases, posts and phone numbers require users to be 18 or older. If you believe a child has given us personal information, email privacy@chargingnear.me and we will delete it.

13. Your Choices and Rights

Choices you can make yourself

  • Delete your account: from your account page. This deletes your account, saved stations, garage, trips, alerts, push subscriptions, driver profile, concierge conversations, API keys, sign-in records, newsletter subscription and any inquiries sent from your account email. Your reviews, photos and tips stay on station pages without your name.
  • Emails: use the unsubscribe link in any marketing email, or change alerts and digests in your account.
  • Texts and calls: reply STOP to any text, or tell us on a call.
  • Location: say no when asked, or turn location off in your browser or device settings.
  • Opt-out of sale, sharing and targeted advertising: turn on Global Privacy Control, or use our Your Privacy Choices page.

Requests

You may ask us to confirm whether we process your personal information, access it or get a portable copy, correct it, delete it, opt out of its sale, sharing or use for targeted advertising or profiling, or limit the use of sensitive information. We offer these to everyone in the United States, whether or not your state’s law requires it, subject to the exceptions the law allows, such as completing a transaction, security, legal claims and record-keeping duties.

Make a request on our Your Privacy Choices page, by emailing privacy@chargingnear.me or by calling (970) 279-1744. We will confirm receipt within 10 business days and respond within 45 days, which we may extend once by up to 45 more days when reasonably necessary, telling you why.

Verification

To protect you, we verify requests to access, correct or delete by confirming that you control the email address on the records, and we may ask for more information if needed. We use that information only to verify the request. Opt-out requests do not need verification.

Authorized agents

You may use an authorized agent. We may require the agent to show your signed permission or a valid power of attorney, and may ask you to verify your identity directly with us.

Appeals

If we deny your request, you may appeal by emailing privacy@chargingnear.me with the subject “Privacy Appeal” within 45 days of our decision. We will respond in writing within 45 days. If we deny your appeal, you may contact your state Attorney General: https://www.naag.org/find-my-ag/.

No discrimination

We will not deny you service, charge you a different price, or give you a different level of service because you used your privacy rights. We do not offer financial incentives for personal information.

14. State Privacy Rights

Residents of states with comprehensive consumer privacy laws have the rights in Section 13 under those laws. As of the date of this policy, those laws are in force in California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky and Rhode Island. We apply the same practices everywhere in the United States.

California residents may also ask, once a year, about disclosures to third parties for their direct marketing (the “Shine the Light” law); we do not make such disclosures.

Nevada

We do not sell covered information as defined in Nevada law. You may still send a request to opt out of any future sale to privacy@chargingnear.me.

15. International Users and Other Websites

We are based in the United States, and the Services are intended for people in the United States. If you use them from elsewhere, your information will be transferred to, stored and processed in the United States, where privacy laws may differ from those where you live.

The Services link to and use services we do not control, such as charging networks, Stripe, map providers and the websites of businesses we list. Their own privacy policies govern how they handle your information, and we are not responsible for their practices.

16. Changes and Contact

We may update this Privacy Policy from time to time. When we do, we will post the new version here and change the date at the top. If we make material changes, we will give you notice before they take effect, such as by email to account holders or a notice on the Services, and will ask for your consent where the law requires. We will not use personal information we already have in a materially different way without your consent where the law requires it.
