Acceptable Use Policy

1. Honest Reviews, Photos and Reports

Reviews, ratings, photos, tips, check-ins and corrections must reflect your own honest, first-hand experience of the station. You may not:

• Review, rate or check in at a station or business you own, manage, work for, are paid by or compete with
• Offer, accept or ask for payment, discounts or anything of value for a review
• Post fake, copied, AI-generated or bulk reviews, or use several accounts, devices or IP addresses to post or vote
• Send false corrections or false “did it work?” answers to change a listing, score or ranking
• Pressure, threaten or pay anyone to change or remove a review
• Post photos you did not take or do not have the right to share, or photos that show people’s faces, license plates or private property in a way that invades their privacy

2. Prohibited Content

Do not post or send content, including through the concierge, that:

• Is unlawful, false, misleading, defamatory, obscene, sexually explicit, hateful, harassing, threatening or violent
• Shows or promotes the sexual exploitation of anyone, or shares intimate images of a person without consent
• Infringes anyone’s copyright, trademark, privacy, publicity or other rights
• Reveals personal information about someone else, such as a phone number, home address or license plate
• Is spam, advertising, a promotion or a link not related to the station, or impersonates any person or business
• Contains malware or code meant to harm, or tries to trick people into giving up information
• Encourages unsafe driving, unsafe charging, tampering with equipment or trespassing

3. Data, Scraping and Automation

You may not, except through our API under our API Terms:

• Scrape, crawl, spider, harvest or copy the Services or their data by automated means, other than public search engines that follow robots.txt
• Copy, resell, redistribute or rebuild our station data, scores, rankings, demand data, reviews or photos as a dataset, directory, map or model
• Get around rate limits, free allowances, paywalls, data gating or authentication, including by rotating accounts, keys, cookies or IP addresses
• Create accounts by automated means or in bulk, or buy, sell or transfer accounts or keys

4. Security and Interference

You may not probe, scan or test the vulnerability of the Services; break or get around security or access controls; access accounts, data or systems that are not yours; overload, flood or attack the Services; or interfere with anyone else’s use. If you find a security issue, report it to legal@chargingnear.me and give us reasonable time to fix it before disclosing it. Good-faith reports that follow this rule and do not access other people’s data, harm the Services or demand payment are welcome.

5. The AI Concierge and AI Agents

Do not use the concierge to generate content for other purposes, to get around its limits, to extract its instructions or underlying systems, to submit other people’s personal information, or to make it produce unlawful or harmful content. AI agents that use the Services must use our API or MCP server, identify themselves honestly and stay within published limits.

6. Businesses and Listings

Businesses may not claim a station they are not authorized to represent, publish false prices, hours, offers or amenities, use another business’s name or marks, or use listing contact details we provide to send spam. Paid placement must not be presented as a review or as our editorial opinion. Businesses may never offer anything of value for a review.

7. Reporting Content

To report a review, photo, tip, profile or listing that breaks this policy, use the report option where it appears, or email legal@chargingnear.me with the subject “Content Report” with a link to the content and why you are reporting it. We review reports and decide what action to take in our discretion. We do not remove honest reviews because they are negative.

8. Intimate Images Shared Without Consent (TAKE IT DOWN Act)

We do not allow intimate images or videos of any person, real or computer-generated, shared without that person’s consent. If you are the person shown, or are authorized to act for them, you can ask us to remove it.

To make a removal request, email legal@chargingnear.me with the subject “TAKE IT DOWN Request” or write to Wins Parking, LLC, 56 Edwards Village Blvd, Unit 124, Edwards, CO 81632, and include:

1. Your physical or electronic signature
2. A link to, or a description of, the image or video and where it appears on ChargingNear.me, so we can find it
3. A brief statement that you believe in good faith that it is an intimate visual depiction of you, or of the person you represent, that was published without consent, with any information that helps us decide
4. How to contact you

We will remove the content within 48 hours after receiving a valid request, and will make reasonable efforts to find and remove identical copies on ChargingNear.me. We may remove content in good faith based on a request without deciding whether it is unlawful. Knowingly false requests may violate the law.

9. Copyright Policy (DMCA)

We respect copyrights and respond to notices that meet the Digital Millennium Copyright Act (17 U.S.C. § 512). We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.

Sending a notice

Send your notice to our designated copyright agent:

Your notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work you say is infringed; (3) identification of the material you say is infringing and where it is on the Services, such as a link; (4) your name, address, phone number and email; (5) a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner. Anyone who knowingly misrepresents that material is infringing may be liable for damages under 17 U.S.C. § 512(f).

Counter-notices

If we removed your content and you believe it was removed by mistake or misidentification, you may send our copyright agent a counter-notice that includes: (1) your physical or electronic signature; (2) identification of the material removed and where it appeared; (3) a statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification; and (4) your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any district where we may be found) and will accept service of process from the person who sent the notice. We may restore the material 10 to 14 business days after receiving a valid counter-notice unless the claimant tells us it has filed a court action.

10. Enforcement

We may, without notice and in our sole discretion, investigate suspected violations; remove, hide or label content; reverse points or contributions; limit features; revoke keys; cancel plans without refund for a material violation; suspend or close accounts; block devices, networks or IP addresses; and cooperate with law enforcement. Our decision not to act on a violation does not waive our right to act on it or others later.
