API Terms
ChargingNear.me is operated by Wins Parking, LLC.
These API Terms govern your use of the ChargingNear.me developer API, keys, data feeds and downloads, the MCP server for AI agents, the embeddable map widget, and the data they return (together, the “API”). They are part of our Terms of Service; where they differ, these API Terms control for the API. By requesting a key or calling the API, you agree to them.
1. Your License
Subject to these API Terms and your plan, Wins Parking, LLC gives you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to call the API and to display the data it returns inside your own applications, websites and AI products for your end users. The API and its data are licensed, not sold. We and our licensors keep all rights not expressly granted.
Facts from U.S. government public records are not owned by us. Our compilation, corrections, enrichment, scores, rankings, demand data, community content and presentation of station data are ours or our licensors’. Third-party data keeps its source license (NREL: public domain; OCM/OSM: ODbL where it applies; TomTom, Google: their terms).
Free citation
Anyone, including search engines and AI assistants, may quote or cite individual facts from our public pages, free and without an API key, with a link to the ChargingNear.me page they come from. Citation does not allow bulk copying, which the rest of these API Terms govern.
2. Access Levels and Rate Limits
| Access | Daily limit | Included each month | Burst |
|---|---|---|---|
| No key (anonymous) | 100 requests per IP address | — | 60 requests per minute |
| Free key | 100 requests | 3,000 requests | 60 requests per minute |
| Starter ($99/month) | 5,000 requests | 150,000 requests | No fixed limit; fair use applies |
| Pro ($295/month) | 25,000 requests | 750,000 requests | No fixed limit; fair use applies |
| Scale ($595/month) | 1,000,000 requests | 30,000,000 requests | No fixed limit; fair use applies |
| Enterprise | As stated in your order form | As stated in your order form | As stated in your order form |
Requests over a daily or burst limit receive an error until the limit resets. Paid plans pay the overage price in the Terms for requests over the monthly included amount. We may change limits, add limits, or throttle or block traffic that threatens the stability, security or fair use of the Services, including traffic that rotates IP addresses or keys to avoid limits. Our usage records control unless they contain a clear error.
3. What Each Plan Returns
Anonymous and free-key requests return the base station directory: location, network, connectors, power, pricing where known, access details, and public community content with its display names. Reliability scores, availability readings and demand data are commercial fields returned only to paid plans. Field names and response formats are documented on our Developers page and may change; we will try to give notice of breaking changes on that page.
Availability readings and other live data exist only where a network or provider reports them to us, and the limits in our Terms about accuracy apply fully to API data.
4. Attribution
Wherever you display our data, show “Data: ChargingNear.me” with a visible link to https://chargingnear.me, or to the station page the data describes, near the data. Responses include an attribution object to make this easy. Do not remove, hide or alter attribution, and do not suggest that we endorse you or your product.
5. Restrictions
You may not, and may not help anyone else to:
- Resell, sublicense, rent or redistribute API data as a dataset, feed, file or API, or offer it to others as a data product
- Build or train a competing directory, map, dataset or model substantially from our data, or use it to bulk-populate another service
- Store or cache data longer than needed to serve your users, beyond 30 days, unless your plan or order form allows it
- Share, publish, sell or embed your API key in public code, or use more keys than your plan allows to raise your limits
- Scrape the website instead of using the API, or get around limits, authentication or paid-field gating
- Pass off commercial fields from a paid plan to others who do not have a paid plan
- Try to re-identify any person from aggregated or de-identified data, or combine our data with other data to identify drivers
- Use the API for unlawful, misleading or harmful purposes, or in breach of our Acceptable Use Policy
- Probe, overload or interfere with the API or its security
6. AI Agents and the MCP Server
AI agents and assistants may use the API and our MCP server within these limits. If you build an agent that answers users with our data, you must show the attribution above in the answer, not present our data as your own, and tell users that station information can be out of date. Training any AI model on our data requires a written agreement with us.
Agent operators
If an AI agent calls the API or MCP server for you, you are its operator: you accept these API Terms for it, and everything it does with the API is done by you.
7. Embeddable Widget
You may embed our map widget on your website as provided. Do not alter, cover or remove its branding or links, frame it in a misleading way, or embed it on sites that break our Acceptable Use Policy. We may change or end the widget, or block it on any site, at any time.
8. Keys, Plans and Billing
Keep your API key secret; you are responsible for all use of it. Tell us right away at legal@chargingnear.me if it is exposed, and rotate it. Paid API plans renew automatically every month until cancelled, and are billed, changed, cancelled and refunded as described in the billing section of our Terms. Enterprise plans and data licenses follow their order form.
9. Changes, Suspension and Termination
We may change, limit, suspend or discontinue the API, any endpoint or field, or your access, at any time, including if you break these API Terms or if we must for legal, security or business reasons. When your access ends, stop using the API and delete cached data, except attribution-bearing data your users already saved where the law requires you to keep it. Paid plans are subject to Section 12 of our Terms.
10. Disclaimers, Liability and Disputes
THE API AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OR SERVICE-LEVEL COMMITMENT unless an order form signed by us says otherwise. The disclaimers, limitation of liability, indemnity, arbitration and class-action waiver, governing law and other terms in our Terms of Service apply to the API. You are responsible for your application and for how it presents our data to your users, and you will indemnify us for claims arising from them.
